A child support order may remain in place for years, but a family’s financial circumstances can change significantly during that time. A parent may receive a raise, lose a job, change careers, or experience another financial change that affects the existing support arrangement.
California child support orders can be modified in appropriate circumstances. However, an existing order generally does not change automatically simply because one parent’s finances have changed.
When Can Child Support Be Changed?
A modification of an existing child support order generally requires a material or substantial change in circumstances.
The circumstances supporting a modification will depend on the particular case. Income and employment changes are common issues because the parents’ financial circumstances are important to the support calculation.
However, a reduction in reported employment income does not necessarily establish that support must be reduced. The court evaluates the evidence concerning the parent’s circumstances rather than simply accepting a change in paycheck amount at face value.
There is also an important exception involving certain below-guideline support agreements. When the parties previously stipulated to support below the guideline level, a change of circumstances does not need to be shown when the requested modification seeks to raise support to the guideline amount or above.
Financial Discovery May Be Necessary
When support modification is disputed, updated financial information can become particularly important.
Discovery can be used in connection with a child support modification proceeding to obtain information about changed circumstances. Document requests and depositions are among the discovery methods that may be used.
The information needed will depend on how a parent earns income.
For a salaried employee, relevant documents may include employment information showing salary and bonus opportunities. Cases involving self-employment, commissions, or other variable compensation can require different or more extensive financial records.
Accurate financial information helps the court evaluate the parents’ current circumstances rather than relying on outdated income figures.
Can You Obtain Updated Income Information Before Filing?
California law also provides a limited way to obtain updated financial information when no child support modification request is currently pending.
The source materials explain that a party may make an annual request for an Income and Expense Declaration and a copy of the other party’s prior-year state and federal income tax returns.
This request cannot be made more than once per year.
The information may help a parent decide whether pursuing a modification makes sense. In some situations, the updated documents may show a significant change in finances; in others, they may show that filing a modification request is unlikely to produce a meaningful difference.
Do Not Assume Support Changes Automatically
One of the practical risks after a major income change is assuming that the existing support obligation has automatically adjusted.
A court order remains important until it is properly modified. Parents considering a change should therefore pay attention not only to whether circumstances have changed, but also to when the appropriate request is made.
Keeping employment, income, tax, and other financial records organized can make it substantially easier to evaluate and support a future modification request.
