Child support is not always based only on wages and taxable investment distributions. A California court may consider the earning capacity of investment assets when a parent’s portfolio is underused or structured in a way that understates resources reasonably available for the child.

Actual Investment Income Is Generally Relevant

Interest, dividends, rents, trust income, annuity payments, and other investment returns may be included in gross income. The court may review both taxable and nontaxable resources rather than relying solely on the adjusted income shown on a tax return.

When returns fluctuate, a representative period may be used to avoid basing support on an unusually strong or weak month.

Underused Assets May Support Imputed Income

A parent generally cannot avoid support by keeping substantial investment assets unproductive without a legitimate reason. When appropriate and consistent with the child’s best interests, the court may attribute a reasonable rate of return to income-producing assets.

This may apply when property is rented substantially below market value, a large portfolio is maintained at an unusually low return, or funds are intentionally placed in nonproductive investments.

Any imputed return should have a reasonable evidentiary foundation. The court should not select an arbitrary percentage merely because the parent owns valuable property.

Home Equity Usually Receives Different Treatment

An increase in the unrealized equity of a parent’s residence is not ordinarily treated as income by simply assigning an assumed rate of return to the home. Doing so could effectively force a parent to sell or refinance the residence to satisfy support.

Substantial wealth or unusual housing circumstances may still be relevant to a request for a special-circumstances adjustment, but that is a separate analysis from automatically treating home equity as monthly income.

Financial Records Should Show the Complete Portfolio

Brokerage statements, rental records, trust documents, account histories, loan information, and evidence concerning market rates may be necessary. The analysis should distinguish genuine long-term planning from deliberate underutilization.

A California child support attorney working with a financial professional can evaluate actual returns, trace available resources, and challenge unsupported income assumptions. The existing child support order remains binding unless the court properly modifies it.
