California may issue a temporary emergency custody order even when another state would ordinarily have authority over the case. Emergency jurisdiction is limited and does not automatically give California permanent control over the custody dispute.

The Child Must Be Present in California

A California court may exercise temporary emergency jurisdiction when the child is physically present in the state and has been abandoned or needs immediate protection from threatened or actual mistreatment or abuse.

The emergency may involve danger directed toward the child, a sibling, or a parent. The requesting party should provide specific evidence explaining the immediate risk rather than relying only on a general disagreement about parenting.

Emergency Jurisdiction Is Usually Temporary

The purpose of an emergency order is to address immediate safety, not to bypass the state that ordinarily has custody jurisdiction.

If another state has already issued an enforceable custody order or has a pending custody proceeding, the California order generally must allow enough time for the requesting party to seek relief from that state. The California court and the other state’s court are expected to communicate about safety and the duration of the temporary order.

A parent cannot create permanent California jurisdiction simply by obtaining emergency relief and waiting.

Permanent Authority Requires a Separate Jurisdictional Basis

If no other state has a qualifying custody case or enforceable order, the California emergency order may remain effective until a court with proper jurisdiction acts. In limited circumstances, California may eventually become the child’s home state and issue a final determination, but that does not occur automatically.

Residence history, previous custody cases, existing orders, and the location of both parents must be disclosed accurately.

Existing Orders Should Not Be Ignored

An out-of-state custody order remains binding unless it is properly modified, stayed, or superseded through an authorized process. A genuine emergency can justify immediate California protection, but it does not authorize a parent to conceal the child or disregard court procedures indefinitely.

A California child custody attorney can request emergency relief, identify the state with continuing authority, and coordinate communication between courts. Addressing jurisdiction at the outset helps protect the child without producing conflicting custody orders.
