Stock options may affect California child support even when the parent has not yet exercised or sold them. Because options can function as employment compensation, the court may consider their value when determining the parent’s ability to support a child.
Options Can Be Compensation Rather Than Only Property
An employer may grant stock options as a bonus, incentive, retention benefit, or substitute for cash compensation. The fact that an option has not been exercised does not automatically make it irrelevant to support.
The court may examine whether the options are vested, currently exercisable, transferable, restricted, or contingent on continued employment. It may also consider the option price, market price, expiration date, tax consequences, and historical exercise pattern.
Options with no present economic value require different treatment from vested options that could produce substantial proceeds immediately.
Property Division and Support Are Different Issues
Stock options may contain community and separate property interests for purposes of property division. That characterization does not necessarily determine whether option-related compensation is available for support.
A spouse may receive options after separation that are separate property but still have income relevant to child or spousal support. Conversely, an option awarded during marriage may be divided as property without justifying duplicate treatment of the same value as support income.
The calculation should avoid counting the identical economic benefit twice.
Variable Compensation May Require a Flexible Order
Options can fluctuate dramatically in value. Using one unusually favorable exercise as fixed monthly income may produce an unrealistic order, while ignoring a regular stream of equity compensation may understate income.
Depending on the evidence, the court may use an income average, base support plus a percentage of option income, or another authorized method. The order should define the relevant event—such as exercise or sale—and explain how taxes and transaction costs will be treated.
Records should also distinguish mandatory withholding from discretionary decisions to retain shares.
Complete Equity Records Are Essential
Relevant evidence may include grant notices, vesting schedules, plan documents, brokerage statements, exercise histories, tax records, and employment compensation summaries. The parent receiving options should disclose restrictions that affect actual access to the value.
A California support attorney can coordinate the income calculation with the property division and develop a method that addresses fluctuating value. Any existing support order remains binding unless modified through the proper legal process.
