No, both parties do not need to agree to divorce- only one party needs to file. This is also known as “no-fault” divorce, where either party can file for divorce without having to prove that the other party is at fault However, the parties should work to agree on important issues such as the division of assets and debts, child custody and visitation, and support in order to proceed with the divorce process. If there is disagreement on these issues, the court will decide the issues.
