A California domestic violence restraining order issued after a hearing may be renewed for at least five years or permanently. The protected person does not have to wait for another incident of abuse before requesting renewal.

The Request Must Be Made Before Expiration

A renewal request may generally be filed during the three months before the order expires. The protected person should review the expiration date early enough to prepare evidence and complete service.

If the order expires before renewal is requested, the person ordinarily cannot renew that same order. A new restraining-order request may be necessary, requiring a new showing for relief.

New Abuse Is Not Required

The absence of new abuse or violations does not by itself defeat renewal. Compliance may show that the existing order has successfully prevented contact or further misconduct.

The court instead considers whether the protected person has a genuine and reasonable concern about future abuse if the order ends. Relevant evidence may include the facts underlying the original order, the seriousness of the prior conduct, changes in circumstances, continued unwanted behavior, and any abuse involving the parties’ children.

The Original Findings Remain Important

A renewal hearing is not necessarily a retrial of whether the original order should have been issued. The prior order and its supporting findings provide important context for evaluating future risk.

The restrained person may present evidence of material changes, sustained compliance, lack of contact, or other circumstances bearing on whether the protected person’s concerns remain reasonable.

Related Family-Law Orders May Have Different Durations

Renewing personal-conduct and stay-away protections does not necessarily renew every custody, visitation, support, or property provision issued with the restraining order. Those orders may be governed by separate rules and should be reviewed individually.

A California domestic violence attorney can calendar the renewal period, organize evidence of continuing risk, and respond to a contested request. Until a restraining order expires or is modified or terminated by the court, every provision remains binding and must be followed.
