A California domestic violence restraining order may protect pets and other animals connected to the parties or their children. These provisions recognize that threats or harm toward an animal may be used to intimidate or control a person.

Different Animals May Be Protected

The protected animal may belong to the requesting person, the parties’ children, or even the restrained person. The issue is whether good cause exists to include the animal in the protective order.

The request should identify the animal clearly through its name, type, breed, color, and other distinguishing information.

Veterinary records, licensing documents, photographs, messages, and evidence of prior threats or mistreatment may support the request.

The Court May Prohibit Harm or Removal

The restrained person may be ordered not to attack, threaten, molest, harm, hide, sell, transfer, borrow against, or dispose of the animal.

The order may also require the restrained person to stay a specified distance from the animal. A stay-away provision can be important when the animal regularly stays at the protected person’s residence or accompanies a child.

Threatening conduct does not have to result in physical injury before protection is requested.

Temporary Care and Possession May Be Assigned

The court may award the requesting person sole possession, care, and control of the animal. This can prevent the animal from being used to force contact or negotiations outside the court process.

Temporary possession under a restraining order does not necessarily resolve every permanent ownership dispute. Broader property rights may need to be addressed separately.

The Order Must Be Followed Exactly

A restrained person should not retrieve, visit, or arrange transfer of the animal without authorization. The protected person also should preserve evidence of any violation and use lawful enforcement procedures.

A California domestic violence attorney can request or oppose animal-protection provisions and coordinate them with residence and property orders. Pet-protection terms remain binding unless modified or terminated by the court.
