How Often Can You Request Updated Child Support Financial Information?

This particular request generally may not be made more than once every 12 months.

Is This the Same as Discovery During a Child Support Modification Case?

No.

Once a child support modification proceeding is pending, broader discovery procedures may become available. Those procedures can be used to investigate disputed income, employment, self-employment, assets, or other financial circumstances relevant to the modification request.

The annual financial-information procedure is narrower. Its usefulness is that it can be employed when no child support modification motion is currently pending.

It can effectively provide an initial financial snapshot before a parent decides whether further court proceedings are appropriate.

Does New Income Automatically Change the Existing Child Support Order?

No.

Obtaining information showing that the other parent’s income has increased or decreased does not automatically modify the current support obligation.

The existing California child support order remains binding unless and until it is modified through the appropriate process.

A parent who receives updated information must still determine whether there is a legal and practical basis to request a new support calculation.

For parents who are uncertain whether circumstances have changed enough to justify returning to court, California’s annual income-information procedure can provide a useful first step.
