A contested California divorce can involve property division, support, reimbursement claims, and numerous other financial disputes. Child custody, however, can require a more immediate resolution because children and parents may need a stable parenting arrangement while other parts of the case continue. California family law provides special trial priority for contested custody issues and, when necessary, requires custody to be tried separately from other unresolved matters.

Custody Can Receive Priority Over Other Divorce Issues

When child custody is the only contested issue in a California family law case, the custody dispute receives preference in the assignment of a trial date over ordinary civil cases, subject to matters that have special legal precedence.

The custody matter must also receive an early hearing.

This recognizes that a family may need a final determination concerning where a child will live and how custody will operate without waiting for every financial dispute in a lengthy California divorce to be ready for trial.

The rule is not limited to cases in which custody is the only disagreement.

When multiple issues remain contested, California requires the custody issue to receive a separate trial and the same priority it would receive if custody were the only contested matter.

As a result, unresolved disputes involving property or other financial matters do not necessarily require the family to postpone a custody trial until the entire divorce can be tried at once.

A Separate Custody Trial Does Not End the Rest of the Case

Trying custody separately is a form of bifurcation.

The family court can decide the custody dispute while retaining jurisdiction over the other unresolved issues.

For example, spouses may still disagree about community property, separate property claims, spousal support, or other financial matters after the custody trial has concluded.

Those issues can continue toward settlement or a later trial.

The custody judgment or order entered after the separate trial must be followed while it remains effective. It is not preliminary guidance simply because other parts of the divorce remain unresolved.

When child support has also been bifurcated, California provides that the custody and child support issues must be tried together.

That connection makes practical sense because the parenting arrangement can be relevant to the California child support calculation.

Custody Priority Does Not Change the Standards Used to Decide Custody

Giving custody an earlier trial does not change the substantive rules the family court must apply.

The court still determines custody according to California’s custody standards, including the child’s best interest and the applicable considerations concerning the child’s health, safety, and welfare.

The parties must also complete procedures required before the custody dispute reaches trial. Contested custody and visitation issues generally involve court-connected mediation or child custody recommending counseling before judicial determination.

Other issues can also affect the procedure. A custody dispute involving domestic violence, for example, may require the court to apply additional statutory custody rules and presumptions.

The priority rule determines when the custody dispute can be heard relative to other contested issues. It does not lower the evidentiary requirements or allow the court to bypass the rules governing the custody determination itself.

Children Do Not Necessarily Have to Wait for Every Divorce Issue to Be Resolved

California gives contested child custody issues special trial priority because resolving a child’s parenting arrangement may be necessary long before every property and financial issue is ready for trial. When other matters remain disputed, custody can be tried separately while the rest of the California divorce continues. Any resulting custody order remains binding unless and until it is later modified or otherwise changed by the court.
