A parent may want to learn whether the other parent’s income has changed before deciding whether to seek modification of child support. California provides a limited method for obtaining updated financial information even when no modification request is pending.
An Annual Request May Be Available
A parent may generally request an updated income-and-expense disclosure and the other parent’s prior-year state and federal income tax returns.
This request may be made no more than once each year. It provides a relatively focused way to review current financial circumstances without first filing a support-modification motion.
The parent receiving the request may serve a similar request in return.
The Information Can Help Evaluate a Modification
Updated records may reveal a substantial salary increase, a job loss, business changes, new investment income, or another development affecting support.
The information also may show that filing a modification request would be unnecessary or unlikely to change the result. Reviewing the records before filing can reduce avoidable litigation and expense.
A child support modification ordinarily requires a material change in circumstances, subject to specific exceptions such as a request to raise a properly stipulated below-guideline order.
Timing the Request Can Matter
If the other parent regularly obtains an extension for filing tax returns, an early request may produce a return from an older tax year. Waiting until the extended filing deadline has passed may provide more current information.
Tax returns alone may not show the complete financial picture of a self-employed parent or business owner. If a modification proceeding is filed, broader discovery may become available to examine business records, compensation, and personal expenses paid by a company.
The Support Order Remains Unchanged
Serving an annual financial request does not modify support. A parent who discovers a significant income change must still use the authorized modification process.
A California child support attorney can review the updated information, calculate a potential guideline change, and determine whether filing is appropriate. Until the court enters a new order, the existing child support amount remains binding.
