California child support is usually calculated using each parent’s actual income, but actual earnings do not always provide the complete picture. When a parent has the ability and opportunity to earn more, the court may consider earning capacity instead of relying solely on present income, provided that doing so is consistent with the child’s best interests.

Earning Capacity Is More Than a Past Salary

A parent’s prior income can be relevant, but it does not automatically establish what the parent can earn now. The analysis may include education, training, work history, licensing, health, employment opportunities, the local job market, and reasonable efforts to obtain suitable work.

For example, a past high-income year may not represent current earning capacity if the industry changed or the income resulted from unusual circumstances. Conversely, voluntarily accepting substantially lower compensation may not control when evidence shows that comparable work is reasonably available.

Ability and Opportunity Require Evidence

The parent asking the court to impute income generally must provide evidence supporting both the other parent’s ability to perform work and a realistic opportunity to earn the proposed amount. Job listings, labor-market information, compensation records, vocational evidence, and employment history may be relevant.

The court’s authority is not limited to cases involving intentional avoidance of support. However, evidence that a parent reduced income to escape family obligations can strongly influence the analysis. The amount attributed must still have a reasonable evidentiary foundation.

Childcare responsibilities may also affect whether additional work is realistically available. The court should evaluate the parent’s actual circumstances rather than assuming that every theoretical job opportunity can be accepted.

Assets May Also Produce Income

In some cases, the court may consider income that could reasonably be generated from investment assets. Property rented below market, funds left unproductively invested, or substantial portfolios may require closer examination.

This does not mean every increase in asset value becomes income. Unrealized growth in the equity of a parent’s home is generally different from accessible income generated by an investment. The nature, liquidity, historical return, and reasonable earning potential of the asset matter.

Presenting a Reliable Child Support Calculation

Parents should provide current tax returns, pay statements, employment records, benefit information, and documents explaining changes in work. A self-employed parent may need business records showing revenue, expenses, owner compensation, and available distributions.

An earning-capacity dispute should remain connected to the child’s best interests and an amount the parent can realistically earn. Inflated assumptions may create an order that cannot be paid, while accepting an avoidable reduction may deprive the child of appropriate support.
