A California divorce may take months or longer to resolve, but families often need rules immediately. Who will remain in the home? What parenting schedule will apply? How will regular expenses and support be handled? A Request for Order can ask the court to establish temporary arrangements while the case moves forward.

What Temporary Orders Can Address

Depending on the case, temporary orders may address child custody and parenting time, child support, spousal support, control or use of property, payment of certain obligations, and other issues authorized by law. The requesting party generally uses Judicial Council Form FL-300 with supporting declarations and any topic-specific forms.

A divorce petition starts the case and identifies categories of requested relief, but it does not automatically schedule every temporary issue for hearing. A party seeking an interim decision should properly present the request, provide notice, serve the papers, and submit the required evidence.

Evidence Should Be Specific and Organized

The court needs facts, not broad accusations. A custody request should explain the child’s existing routine, school schedule, childcare, transportation, safety concerns, and the practical schedule being proposed. A support request should include complete and current income and expense information. A property-related request should identify the asset, the requested control or restraint, and why temporary relief is necessary.

Declarations should be direct, chronological, and connected to the orders requested. Relevant records may include pay statements, school calendars, communications, account statements, invoices, or existing written agreements. Submitting a large collection of unexplained exhibits can make important facts harder to find.

Emergency Requests Have a Higher Threshold

Not every urgent personal concern qualifies for an order without regular notice. In custody matters, a California court generally may not grant or modify custody on an emergency basis unless there is a showing of immediate harm to the child or an immediate risk that the child will be removed from California. When the standard is not met, the issue ordinarily proceeds through a noticed hearing.

Early Orders Can Shape the Case

Temporary does not mean unimportant. Parenting patterns established early may become difficult to change after children adjust to them. Financial orders also remain enforceable while they are in effect, and amounts that accrue may not be erased later. A rushed proposal can create months of avoidable conflict.

When parents have an agreement concerning temporary custody, that agreement or a declaration describing it should be attached to the relevant filing. Clear, workable terms can reduce uncertainty and may allow the court to adopt an arrangement promptly, absent exceptional circumstances.
