A domestic violence restraining order may include a residence exclusion provision requiring one party to leave a family home, shared dwelling, or another qualifying residence. This is commonly called a move-out order. The court’s authority does not necessarily depend on which person holds title or signed the lease.
Because exclusion from a home is significant relief, the required showing depends on whether the order is requested on an emergency basis or after notice and a hearing. Timing and evidence therefore matter.
Emergency Exclusion Requires Specific Facts
For an emergency move-out order, the requesting party generally must show a legal right to possess the residence. The request must also establish qualifying assault or threatened assault and that physical or emotional harm would otherwise result to the requesting party, a person under that party’s care, or a minor child.
The declaration should describe recent incidents, threats, injuries, access to the home, and the danger created by continued shared occupancy. Broad claims without dates or supporting facts may not establish the need for immediate exclusion.
Evidence may include photographs, messages, police reports, medical records, witness declarations, and prior protective orders.
Different Standards Apply After Notice and Hearing
After the restrained person receives notice and an opportunity to be heard, the court may order exclusion when physical or emotional harm would otherwise result. A separate showing of assault or threatened assault is not always required at that stage.
The court considers the evidence presented by both parties. Ownership and lease rights remain relevant to later property issues, but they do not necessarily prevent a temporary protective order controlling possession of the home.
A move-out order does not finally determine title, community-property characterization, or the ultimate division of the residence in a divorce.
Property and Payment Terms Should Be Clear
Protective orders may address temporary use, possession, and control of real or personal property, as well as responsibility for liens or other obligations coming due. Clear provisions can reduce disputes about mortgage payments, rent, utilities, vehicles, personal belongings, and access to retrieve necessary items.
Neither party should use a property retrieval as an opportunity for unauthorized contact. Law-enforcement assistance or another structured process may be appropriate when provided by the order.
Compliance Is Required Immediately
Once issued and properly effective, a move-out order is binding unless modified, stayed, terminated, or otherwise changed through an authorized process. Disagreement over ownership does not permit self-help or reentry in violation of the order.
